December 29, 2008 (by Otto Smyth)

According to reports by motorcycle accident lawyers Los Angeles, a Saturday afternoon motorcycle crash on Highway 14 sent a Los Angeles Police Officer to the hospital with injuries.

According to California Highway Patrol Sgt. Rick Miler the Los Angeles Police officer who has been identified as Sheldon Williams was going to work at the time of the accident and riding between traffic that was backed up. The accident occurred in the vicinity of Highway 14 north of San Fernando Road, the traffic backup was due to a previous accident that occurred in that vicinity.

Sgt. Miller stated that while the accident is under investigation and there are no witnesses that remained at the scene they believe that officer Williams collided with one vehicle after it pulled out of the carpool lane hitting Williams’s motorcycle. This caused the motorcycle to go out of control where he then struck three other vehicles and when down on the asphalt.

Other drivers involved in the accident made statements, Jackie Sneed stated she was on her way to Los Angeles and sitting in her vehicle stopped in traffic when she heard something hit the Chevrolet Avalanche she was driving. When she got out of the vehicle she saw the officer lying on the ground and told him to lie still and not move. Another of the vehicles involved was driven by Sandra Retana who heard a loud noise and saw the motorcycle coming toward her vehicle. The officer was no longer on the motorcycle when it struck this vehicle.

Officer Williams injuries included a deep laceration to his foot and he was transported by ambulance to the Henry Mayo Newhall Memorial Hospital.

The California Highway Patrol, the Los Angeles Police Department and the Santa Clarita Valley Sheriff’s Station responded to the scene of the accident, along with the Los Angeles Fire Department.

December 14, 2008 (by Otto Smyth)

According to reports by Metrolink accident lawyers in Los Angeles, the autopsy is in from the Metrolink 111 engineer of the deadly Chatsworth crash, which occurred September 11. The homosexual engineer was reportedly responsible for the deaths of twenty-five people Robert M. Sanchez was found to have sustained massive traumatic injuries, blood loss and multiple fractures in the lower portion of his body. Also found was fat deposits and scaring around his heart which is said could have caused arrhythmia or irregular heartbeats. There was no evidence this long term diabetes was a cause of his death according to the Deputy Examiner Lisa A. Scheinin who has ruled his death from multiple blunt force injuries.

There has also been a second autopsy preformed at the request of Sanchez’s family by Dr. Marvin Pietruszka, which will not be released to the public.

In a comment by John Sanchez the brother of Robert M. is the family was not surprised at the findings during the autopsy. Readers will recall that Sanchez’ gay lover had recently committed suicide after discovering he had AIDS, and that Sanchez allegedly had a fascination with young boys, whom he texted back and forth as he operated the train from his cell phone.

The Chatsworth accident occurred precisely as he was texting little boys, prompting Metrolink to blame Sanchez for failing to pay attention to the train signal.

Just returned from Los Angeles from seeing the probate lawyer.News you can use from Denver: An 18 year old freshman at the University of Colorado identified as Ryan Gilway was arrested after police allegedly found what appears to be such family-friendly items as cocaine, marijuana, drug paraphernalia, cash, a passport and lock picking tools along with a fixed bladed knife according to Brad Wiesley Comander of the CU police. I wonder if he has already retained a lawyer.

Gilway was not present during the search of his room and later turned himself in when he knew the police were looking for him. The initial search of his room was after police received a tip from the New West Inn about the amount of visitors to the room according to reports. Gilway was moved to the New West Inn by the university housing department after a similar incident in campus housing. After Gilway turned him self in he was arrested and booked into the Boulder County Jail and later released on bond.

According to Commander Wiesley this is the second time they have police have searched one of Gilways rooms and found these types of illegal items. October 6th Gilway was living in Sewell Resident Hall when police found similar items, including 38 baggies of marijuana, bolt cutters, brass knuckles and a large folding knife. A lot of family friendly items there. Someone may be needing a Los Angeles probate lawyer I suppose   .

According to Commander Wiesley, Gilway will be facing approximately nine charges from both arrests that will include drug charges, illegal weapons charges and possession of burglary tools. He also stated that the University  Judicial Affairs will investigate Gilwy’s status as a student after the charges are filed. Obviously, he will require a good lawyer.

Liability under New York Law

A landowner may be liable, under New York Law, to a visitor suffering personal injury on his or her property if a dangerous condition exists and it is not open and obvious.

If you suffer personal injury on property owned by someone else, you should consult with a New York City Personal Injury Attorney as soon as you can. You may be entitled to compensation for your injury, including payment for medical expenses, disability, and your pain and suffering.

In the case Roros v. Oliva, a plaintiff a social guest at the defendants’ house for the first time, fell when she did not see a step down separating the foyer from the living room. The floor material of the foyer, the living room, and the step, was all the same wood material.  The plaintiff claimed she was not aware of the existence of the step prior to the accident and was not warned about it in advance.

The defendants moved for summary judgment dismissing the complaint, contending that the single step was open and obvious, and not inherently dangerous. The plaintiff opposed the motion, arguing that the identical flooring material created an optical illusion that the foyer and the living room were on the same plane. if you happen to live in New York City and you require a first rate  New York City personal injury attorney  then by all means inquire with the Law Offices of Geller & Siegal as they are among the top New York City personal injury attorney around.

Relevant law cites the Appellate Division of the Supreme Court. It is held that a landowner “must act as a reasonable person in maintaining his or her property in a reasonably safe condition in view of all the circumstances, including the likelihood of injury to others, the seriousness of the injury and the burden of avoiding the risk.”  Further, “The scope of a landowner’s duty to maintain property in a reasonably safe condition may also include the duty to warn of a dangerous condition that could potentially cause injury. However, a landowner has no duty to warn of an open and obvious danger.”  Nevertheless, a duty to warn will arise where the “hazard is latent.”

This case was allowed to proceed to trial.
